Smilewhite.co.uk (the “Website”) is operated by Smile White Holdings Ltd (“Smile White”, “we” or “us”). On this Website, we provide users with access to professional dental care, where they can book a free online consultation call or complete a free online smile analysis (collectively, “Services”), along with purchasing standalone dental care products (collectively, “Products”).
Please review our Terms of Use and Conditions of Sale (“Terms and Conditions” or “Terms”) carefully. They apply when you use our Website, obtain any related Services and/or purchase any of the Products. If you do not accept these Terms and Conditions, you must not use our Website, obtain Services or purchase any of the Products.

When you place an order to purchase a Product from Smile White, you agree to be bound by the Terms and Conditions by this reference.
We will notify you by email as soon as possible to acknowledge receipt of your order and to provide you with an email containing a legally binding Contract of Sale (the “Contract”). We will confirm acceptance of your order by sending you an email once you have electronically signed the Contract. If we are unable to fulfill your order following this acknowledgement, we will contact you by email or telephone advising you of this. By purchasing Products and Services from Smile White, you consent to receiving sales invoices electronically. Please note that we reserve the right to reject any offer to purchase by you at any time.
Subscription Orders
Through the use of our Website, you have the option to sign up for a subscription with us (a “Subscription”) to receive, on a periodic basis, deliveries of Products (in each case, a "Subscription Order”). Your Subscription Order is not accepted by us until we have contacted you to tell you that we have accepted your Subscription Order.
If you want your Subscription to be deactivated ahead of your Subscription Order, you will need to deactivate your Subscription three days prior to your renewal date.
User Conduct
You may not use any “deep-link”, “page-scrape”, “robot”, “spider” or other automatic device, programme, algorithm or methodology, or any similar or equivalent manual process, to access, acquire, copy or monitor any portion of the Website or any Content, to obtain or attempt to obtain materials, documents or information through any means not purposely made available through the Website. Smile White reserves the right to bar any such activity.
You may not attempt to gain unauthorised access to any portion of feature of the Website, or any other systems or networks connected to the Website or to any Smile White server, or to any of the services offered on or through the Website, by hacking, password “mining” or any other illegitimate means.
You may not probe, scan or test the vulnerability of the Website or any network connected to the Website, nor breach the security or authentication measures on the Website or any network connected to the Website. You may never reverse look-up, trace or seek to trace any information or any other user of or visitor to the Website, or any other customer of Smile White, or exploit the Website or any service or information, including but not limited to personal identification or information. other than your own information, as provided by the Website.
You agree that you will not take any action that imposes an unreasonable or disproportionately large load on the infrastructure of the Website or Smile White’s systems or networks, or any systems of networks connected to the Website or to Smile White.
You agree not to use any device, software or routine to interfere or attempt to interfere with the proper working of the Website or any transaction being conducted on the Website, or with any other person’s use of the Website.
You may not forge headers or otherwise manipulate identifiers in order to disguise the origin of any message or transmittal you send to Smile White on or through the Website or any Service offered on or through the Website.
You may not use the Website or any Content belonging to us or any third party for any purpose that is unlawful or prohibited by these Terms, or to solicit the performance of any illegal activity or other activity which infringes the rights of Smile White or others.
Dentist Availability
Smile White is not responsible, nor in control of, the availability of Smile White partner dentists (“Partner Dentists”), for Smile White Products and/or Services. It is the responsibility of the Smile White partner dentist and/or practice to contact their assigned Smile White patient to arrange and schedule all relevant dental appointments related to, or in association with, the specific Smile White purchase of Product and/or Services.
Smile White reserves the right to withhold private or confidential information in relation to Partnered Dentists and practices from visitors, users, and other third parties, of this Website and paying customers.
If any form of appointment with a Partner Dentist needs to be rearranged by a customer, you may do so within no less than 48 hours of your agreed appointment time with your assigned Partner Dentist. If you need to reschedule your appointment with the Partner Dentist, you must contact them using the telephone number provided, as well as send a written request via email to the email address provided by the Partner Dentist at the time of the original booking. Smile White are not responsible for rescheduling further appointments between the customer and the Partner Dentist.
The customer cannot cancel an appointment with a Partner Dentist and we do not offer refunds on purchases due to a change of mind, as stated in our Refund Policy. You have a period of three months from the date of purchase to reschedule your original appointment, if required, or forfeit the fee paid for the Product. If you cancel any further appointments with a Partner Dentist after the original appointment time and date, the fee paid for the Product will be forfeited.
Product Availability
All orders for Products are subject to the availability of those Products and the materials for making the Products. We will inform you as soon as possible after placing an Order if, for any reason, the Products you have ordered are not available or are subject to any delay,
If we are unable to supply you with a Product, for example, because the manufacturer is out of stock or because of an error in the price, we will inform you of this by email and we will not process your order. If we have already processed your payment, we will refund you the full amount as soon as possible.
We reserve the right, but are not obligated, to limit the sales of any of our Products to any person or jurisdiction, and we reserve the right to limit the quantities of any Products that we offer. We reserve the right to, at any time, modify the specification of our Products or discontinue any Products without notice at any time.
We make reasonable efforts to display as accurately as possible the colours and images of our Products that appear on the Website. A Product’s true colour may not exactly match that shown on your device or on our Website or its packaging may be slightly different.
Delivery
Any dates of delivery that we provide to you in respect of any Orders are estimates only, and we are not liable for any loss incurred as a result of not meeting any estimated delivery dates that we provide to you.
Use of Products
You shall use any Products only in accordance with our directions for use of those Products, as provided to you from time to time. We shall not be liable to you for any loss or damage incurred as a result of your use of the Products that is in any way not in accordance with our directions of use.
The Products are for personal use only and shall not be provided to any third party. We shall not be liable to you or to any third party for any loss or damage incurred as a result of the use of any Products that you have purchased by any third party.
We reserve the right to refuse any Order and to cancel Orders that, in our sole judgement, appear to be placed by dealers, resellers or distributors.
Payment
We use a third part payment processor, Shopify (the “Payment Processor”), to charge you for your Products, Services and/or Subscription purchased through the Website. The processing of your payments will be subject to Shopify's terms and conditions alongside these Terms. The processing of your payments will be taken automatically from the payment card prior to our delivery or acceptance of each Order. Where you have signed up to a Subscription and/or Service and/or Product, and unless you cancel your Subscription and/or Order in accordance with these Terms, we will take payment from you prior to the delivery of Each Subscription Order and/or Product.
Cancel Order
You may cancel an Order in accordance with our Refund Policy.

Contraindications
In purchasing any Product from Smile White, you agree that Smile White is not responsible for any dental treatment required for remedial work, including, but not limited to, fillings, crowns, root canals, hygiene appointments (collectively, “Remedial Work”). Our Products, Services and Subscriptions are sold on the basis that you, the customer, has a ‘healthy mouth’, which means you do not have oral health issues, including, but not limited to, gingivitis, tooth decay and other ailments.
Smile White partner dentists do not operate under an NHS dental scheme and will charge patients on a private basis. Once the agreed dental work has been carried out, by either a Smile White partner dentist or dentist of your choice, to achieve a ‘healthy mouth’, the measurements for the purchased Smile White Products and/or Services can be released to the manufacturer and made to order.
We are not liable for the difference in colour that customers may experience if they choose to use the Smile White Teeth Whitening Kit with dental restorations (a “Restoration”), including, but not limited to, crowns, veneers or fillings, and if they choose not to replace these Restorations at a separate cost beforehand.
Our Products and/or Services, including, but not limited to, clear aligners, teeth whitening and retainers, do not guarantee that the intended results will be achieved. By purchasing a Product, Service and/or Subscription from Smile White, you agree that we, as well as our representatives, successors, assigns, agents, employees and agents cannot offer assurances or guarantees of any kind concerning any specific outcome of treatment, due to the medical nature of our Products and Services.

Some jurisdictions do not allow limitations of liability, so the foregoing limitation may not apply to you.
Indemnification
